ACCEPTABLE USE POLICY

This Acceptable Use Policy (“Policy”) describes the rules that apply when accessing or using GrowthMate’s websites, applications, dashboards, artificial-intelligence features, analytics integrations, reports, alerts, communication services, APIs, and related services collectively referred to as the “Services.”

GrowthMate is operated by Qoptervzn Infocom Private Limited, a company based in Bhandara, Maharashtra, India (“GrowthMate,” “Company,” “we,” “us,” or “our”).

This Policy forms part of the GrowthMate Terms of Service. By accessing or using the Services, you agree to comply with this Policy and all applicable laws, regulations, platform requirements, and third-party terms.

1. Scope

This Policy applies to:

• Customers and subscribers;
• Account owners and administrators;
• Employees, contractors, agents, and authorised users of a customer;
• Visitors using GrowthMate’s websites or applications;
• Users connecting third-party accounts, analytics properties, advertising accounts, websites, applications, communication channels, or other data sources to GrowthMate; and
• Anyone accessing GrowthMate through an API, integration, shared report, invitation, white-label service, or other authorised method.

You are responsible for ensuring that all persons using the Services through your account comply with this Policy.

2. Permitted Use

You may use GrowthMate only for lawful business, analytics, reporting, marketing, website-performance, advertising-performance, search-performance, and related operational purposes.

Permitted uses may include:

• Connecting analytics, advertising, search, website, ecommerce, business-profile, CRM, or similar accounts that you are authorised to access;
• Analysing website, application, campaign, conversion, revenue, audience, or business-performance information;
• Receiving automated reports, alerts, summaries, and AI-generated recommendations;
• Delivering authorised reports through email, WhatsApp, dashboards, exports, or other supported channels;
• Monitoring traffic, conversions, campaign performance, tracking quality, anomalies, and technical issues;
• Sharing reports with authorised employees, customers, contractors, agencies, or business partners;
• Using white-label features for legitimate client-reporting purposes; and
• Using recommendations and insights to support lawful business decisions.

GrowthMate’s reports and AI-generated recommendations are informational tools. You remain responsible for reviewing their accuracy, suitability, legality, and relevance before relying on or acting upon them.

3. General Prohibited Uses

You must not use, attempt to use, or permit another person to use the Services for any unlawful, fraudulent, harmful, deceptive, abusive, or unauthorised purpose.

Prohibited activities include the following.

3.1 Illegal Activities

You must not use the Services to:

• Violate any applicable local, state, national, or international law or regulation;
• Facilitate fraud, theft, money laundering, bribery, corruption, tax evasion, trafficking, sanctions evasion, or other criminal activity;
• Promote, sell, distribute, or facilitate illegal products or services;
• Violate court orders, government restrictions, regulatory requirements, or legally binding obligations;
• Circumvent licensing, registration, age, geographic, or regulatory requirements; or
• Assist another person in carrying out an unlawful activity.

3.2 Fraud, Scams, and Deceptive Practices

You must not use GrowthMate to create, support, analyse, optimise, distribute, or conceal:

• Fraudulent offers, investment schemes, impersonation scams, phishing campaigns, pyramid schemes, or deceptive business models;
• False, misleading, exaggerated, or unsubstantiated claims;
• Fake testimonials, fabricated reviews, false endorsements, or manipulated social proof;
• Deceptive pricing, hidden subscription terms, unauthorised recurring charges, or unclear cancellation practices;
• Advertisements or landing pages that conceal the identity of the advertiser or the nature of the product or service;
• Offers for products or services that do not exist or cannot reasonably be delivered;
• Misleading claims of affiliation, approval, certification, sponsorship, partnership, or endorsement;
• Attempts to evade advertising-platform review or enforcement systems; or
• Cloaking, destination switching, account farming, identity manipulation, or other policy-circumvention practices.

3.3 Misuse of Analytics and Advertising Data

You must not use the Services to:

• Generate, purchase, automate, or conceal fake traffic, fake leads, fake conversions, fake engagement, or fraudulent transactions;
• Engage in click fraud, impression fraud, attribution fraud, affiliate fraud, conversion manipulation, or advertising-budget abuse;
• Falsify analytics data, campaign results, attribution data, reports, screenshots, invoices, or performance claims;
• Intentionally contaminate analytics properties with false, malicious, or misleading data;
• Manipulate tracking systems to improperly claim commissions, incentives, revenue, credit, or advertising performance;
• Circumvent consent requirements, tracking restrictions, browser protections, device settings, or user privacy choices;
• Collect sensitive personal information through analytics events, dimensions, URLs, page titles, campaign parameters, or similar fields where such collection is prohibited;
• Re-identify individuals from anonymised, aggregated, pseudonymised, or de-identified data without lawful authority;
• Combine datasets for unlawful surveillance, discrimination, profiling, or tracking; or
• Use reports or insights to target, exploit, deceive, or unlawfully discriminate against individuals or protected groups.

3.4 Unauthorised Access and Connected Accounts

You may connect or access only accounts, properties, websites, applications, advertising accounts, business profiles, communication channels, or datasets that you own or are expressly authorised to manage.

You must not:

• Connect another person’s account without permission;
• Use stolen, purchased, shared, fabricated, or improperly obtained login credentials;
• Request or obtain more permissions than reasonably necessary;
• Access data after your authorisation has expired, been revoked, or otherwise ended;
• Use another customer’s tokens, keys, credentials, reports, or account information;
• Misrepresent your relationship with a client, employer, advertiser, website owner, or data controller;
• Bypass authentication, authorisation, access controls, or account restrictions; or
• Transfer, sell, lease, publish, or disclose credentials, access tokens, API keys, or authentication secrets.

You must promptly disconnect integrations and remove access when you no longer have authority to access the connected account or data.

3.5 Privacy and Personal-Data Abuse

You must not use GrowthMate to collect, process, disclose, sell, share, monitor, or otherwise use personal data without a valid legal basis and appropriate notice.

You must not:

• Upload or transmit personal data that you are not legally authorised to process;
• Collect passwords, financial credentials, authentication secrets, government identification numbers, health records, biometric data, precise location data, or other highly sensitive information through improper means;
• Use GrowthMate for unlawful employee monitoring, consumer surveillance, stalking, harassment, or location tracking;
• Sell or provide personal data obtained through GrowthMate to data brokers, surveillance providers, or unauthorised third parties;
• Use Google user data, Meta data, analytics data, or other connected-platform data for purposes unrelated to the functionality disclosed to and authorised by the relevant user;
• Use connected-platform data for advertising where such use is prohibited by the relevant platform;
• Retain connected-account data longer than permitted by applicable law, your agreement, or the relevant platform;
• Ignore a valid request to delete, correct, access, restrict, or withdraw consent relating to personal data;
• Attempt to identify a person from data that is intended to remain anonymous or aggregated; or
• Use personal data to make unlawful or unfair decisions involving employment, housing, credit, education, insurance, healthcare, or access to essential services.

You are responsible for providing all legally required notices and obtaining all legally required consents from your website visitors, application users, customers, employees, and other relevant individuals.

4. Google, Meta, and Third-Party Platform Requirements

When you connect or use Google, Meta, WhatsApp, advertising, analytics, search, ecommerce, email, payment, CRM, hosting, or other third-party services, you must comply with the terms and policies of those providers.

You must not use GrowthMate to:

• Violate Google Ads policies, Google API requirements, Google Analytics requirements, Google user-data requirements, or other applicable Google terms;
• Violate Meta Advertising Standards, Meta Platform Terms, WhatsApp Business policies, or other applicable Meta terms;
• Circumvent an account suspension, advertising restriction, developer restriction, API quota, or enforcement decision;
• Create replacement accounts, identities, domains, payment profiles, or integrations to evade an existing restriction;
• Use API data for a materially different purpose from the purpose disclosed during authorisation;
• Sell, transfer, or disclose third-party platform data where prohibited;
• Use platform data to conduct surveillance or create unlawful profiles;
• Misrepresent the source, accuracy, scope, ownership, or permitted use of platform data;
• Request unnecessary permissions or access scopes;
• Continue using data after authorisation has been revoked; or
• Encourage another person to violate a third-party platform’s rules.

GrowthMate may restrict or disconnect an integration where we reasonably believe that continued access could violate applicable law, user expectations, security requirements, or third-party platform policies.

5. Email, WhatsApp, and Electronic Communications

You may use GrowthMate’s communication features only to send reports, alerts, notifications, and other messages to recipients you are legally authorised to contact.

You must not use the Services to:

• Send spam, bulk unsolicited messages, or unlawful marketing communications;
• Send messages to purchased, scraped, harvested, rented, or improperly obtained contact lists;
• Continue sending non-essential communications after a recipient has opted out;
• Mislead recipients about the sender, purpose, origin, or commercial nature of a message;
• Disguise or manipulate sender information, reply-to information, links, or message headers;
• Send phishing links, malware, malicious files, or deceptive login requests;
• Send content that violates applicable anti-spam, telecommunications, consumer-protection, or privacy laws;
• Send messages in violation of WhatsApp, email-provider, telecommunications-provider, or other communication-platform policies;
• Use automated communication to harass, threaten, intimidate, or pressure a recipient; or
• Send reports containing confidential or personal information to an unauthorised recipient.

You are responsible for maintaining appropriate consent records, contact preferences, suppression lists, unsubscribe mechanisms, and proof of authorisation.

6. Prohibited Content and Industries

You must not use the Services to promote, optimise, report on, or facilitate content, products, or services that are illegal or prohibited by applicable law or the relevant platform.

Prohibited content includes:

• Child sexual abuse or exploitation material;
• Sexual content involving minors or content that endangers children;
• Human trafficking, sexual exploitation, or non-consensual sexual content;
• Terrorism, violent extremism, or recruitment for violent organisations;
• Credible threats, instructions for violence, or glorification of serious harm;
• Hate speech or content that promotes violence or discrimination against protected groups;
• Harassment, bullying, stalking, doxxing, or publication of private information;
• Illegal drugs, controlled substances, or instructions for producing them;
• Illegal weapons, explosives, or instructions intended to cause serious harm;
• Counterfeit goods, stolen goods, or unlawful intellectual-property infringement;
• Malware, ransomware, spyware, credential theft, phishing, or hacking services;
• Organ trafficking, illegal wildlife trade, or other unlawful trafficking;
• Fraudulent financial products, deceptive investment opportunities, or illegal gambling;
• Academic cheating, forged qualifications, falsified documents, or identity fraud; and
• Any content that is unlawful in the location where it is created, accessed, promoted, delivered, or targeted.

Certain lawful but regulated industries—including healthcare, financial services, gambling, alcohol, political advertising, dating, employment, housing, credit, insurance, and age-restricted products—may be subject to additional restrictions.

You may use GrowthMate in connection with a regulated industry only where:

• The activity is lawful;
• You hold all required licences and approvals;
• The relevant advertising, analytics, communication, and platform policies allow it;
• Required age and geographic restrictions are applied;
• Required disclosures and disclaimers are provided; and
• GrowthMate has not separately prohibited or restricted the activity.

7. Security Abuse

You must not interfere with the security, integrity, availability, performance, or normal operation of GrowthMate or any connected service.

You must not:

• Probe, scan, or test vulnerabilities without our prior written authorisation;
• Attempt to gain unauthorised access to accounts, systems, databases, networks, source code, or administrative functions;
• Introduce malware, viruses, ransomware, spyware, harmful code, or destructive files;
• Conduct denial-of-service attacks or deliberately overload the Services;
• Abuse API quotas, rate limits, storage limits, processing limits, or messaging limits;
• Use automated tools to scrape, crawl, extract, or copy the Services except through an expressly authorised interface;
• Attempt to bypass security controls, usage limits, subscription restrictions, or feature restrictions;
• Intercept communications or data that are not intended for you;
• Attempt to discover, extract, reverse engineer, or misuse credentials, tokens, encryption keys, or secrets;
• Exploit a vulnerability after discovering it;
• Publicly disclose an unremediated vulnerability in a way that creates material risk; or
• Assist another person in carrying out a security attack.

Security research must be authorised in writing before testing begins.

8. Abuse of Automation and Artificial Intelligence

You must use GrowthMate’s automation and AI features responsibly.

You must not:

• Use AI-generated outputs to deceive, impersonate, defraud, harass, or manipulate another person;
• Represent an AI-generated analysis as independently audited, professionally certified, or guaranteed unless that statement is accurate;
• Use automated reports or recommendations as the sole basis for decisions that could significantly affect a person’s legal rights, employment, housing, credit, insurance, education, healthcare, or access to essential services;
• Generate or distribute knowingly false performance claims;
• Automate actions that violate a third-party platform’s rules;
• Use automated systems to create excessive requests, messages, reports, accounts, or integrations;
• Attempt to extract system prompts, model configurations, security controls, or confidential internal information;
• Use the Services to develop, train, benchmark, or improve a competing product through unauthorised extraction or bulk collection;
• Remove or conceal required AI disclosures; or
• Rely on AI-generated recommendations without appropriate human review where the decision may create material risk.

GrowthMate does not guarantee that AI-generated reports, summaries, forecasts, alerts, classifications, or recommendations will be complete, current, accurate, or suitable for every purpose.

9. Intellectual Property and Confidential Information

You must not use GrowthMate to:

• Infringe copyrights, trademarks, patents, trade secrets, publicity rights, database rights, or other intellectual-property rights;
• Upload, reproduce, distribute, or commercially exploit content without appropriate rights or permission;
• Remove copyright notices, trademarks, attribution, or ownership information;
• Misappropriate confidential information, proprietary data, customer lists, source code, business strategies, or trade secrets;
• Share confidential reports or connected-account data with unauthorised persons;
• Use another organisation’s name, logo, branding, or identity without permission; or
• Falsely claim ownership of data, reports, websites, accounts, campaigns, or intellectual property.

You must have all rights and permissions necessary for the information, branding, content, and data you submit to the Services.

10. Account and Subscription Abuse

You must not:

• Create accounts using false, misleading, stolen, or unverifiable information;
• Share an account beyond the number of authorised users included in your subscription;
• Resell, sublicense, rent, or commercially provide access to the Services unless expressly authorised;
• Create multiple accounts to obtain repeated trials, credits, discounts, or promotional benefits;
• Use chargebacks or payment disputes fraudulently;
• Avoid payment obligations through technical or administrative manipulation;
• Access paid features without a valid subscription or authorisation;
• Transfer an account to another person without authorisation;
• Use another person’s payment method without permission; or
• Conceal the true person or organisation controlling an account.

White-label and agency use is permitted only where included in your subscription or separately authorised by GrowthMate.

11. Customer Responsibilities

You are responsible for:

• All activity conducted through your account;
• Maintaining accurate account and billing information;
• Protecting passwords, credentials, access tokens, API keys, and authentication devices;
• Configuring appropriate permissions for authorised users;
• Reviewing connected accounts and removing access when no longer required;
• Ensuring that your use of analytics, cookies, advertising technologies, email, WhatsApp, and other communication tools complies with applicable law;
• Obtaining required user consent before collecting or processing data;
• Verifying the accuracy of reports and recommendations before acting upon them;
• Maintaining any required licences, registrations, notices, disclosures, and records;
• Responding to privacy, deletion, opt-out, and consent-withdrawal requests;
• Ensuring that reports are sent only to authorised recipients; and
• Promptly notifying GrowthMate about suspected account compromise, data misuse, unauthorised access, or policy violations.

12. Monitoring and Investigation

GrowthMate may use automated systems and manual review to detect security threats, abuse, fraud, prohibited activity, excessive usage, and violations of this Policy.

To the extent permitted by applicable law, we may investigate suspected violations and review relevant account information, system logs, metadata, usage records, connected-service status, support communications, and other information reasonably necessary to protect the Services and their users.

We are not obligated to proactively monitor every account, report, integration, communication, or activity.

13. Enforcement

Where we reasonably believe that you have violated this Policy, applicable law, third-party requirements, or the rights of another person, we may take one or more of the following actions:

• Warn you or request corrective action;
• Remove, block, restrict, or disable content, reports, messages, features, or integrations;
• Restrict API requests, data processing, exports, communications, or automation;
• Require additional identity, authority, ownership, or compliance verification;
• Revoke access tokens or disconnect third-party accounts;
• Temporarily suspend your account;
• Permanently terminate your account or subscription;
• Preserve relevant records where legally permitted or required;
• Notify an affected customer, user, platform provider, payment provider, regulator, or law-enforcement authority where appropriate;
• Refuse to process or refund payments where permitted under the Terms of Service and applicable law; or
• Take legal action.

For serious violations—including fraud, security attacks, child exploitation, unlawful surveillance, sanctions violations, or conduct that creates an immediate risk—we may act without prior notice.

Enforcement decisions may consider the severity, duration, frequency, intent, impact, prior violations, and willingness to correct the violation.

14. Reporting Violations

You should promptly report suspected misuse, fraud, unlawful content, security incidents, privacy violations, or other violations of this Policy.

Please include sufficient information for us to identify and investigate the issue. Do not include unnecessary sensitive personal information in your report.

Submitting a knowingly false, malicious, or misleading report is prohibited.

15. Cooperation with Authorities and Third Parties

GrowthMate may cooperate with courts, law-enforcement authorities, regulators, government agencies, platform providers, payment processors, and affected parties where required or permitted by applicable law.

We may preserve or disclose information in response to valid legal process or where reasonably necessary to:

• Comply with applicable law;
• Protect the rights, property, security, or safety of GrowthMate, our customers, users, or the public;
• Investigate fraud, security incidents, or serious Policy violations;
• Enforce our agreements; or
• Respond to an emergency involving a risk of death or serious physical harm.

16. No Waiver

A failure or delay by GrowthMate in enforcing this Policy does not waive our right to enforce it later.

Where an activity is not expressly prohibited in this Policy, that does not mean the activity is permitted. You must use the Services reasonably, lawfully, securely, and consistently with their intended purpose.

17. Changes to This Policy

We may update this Policy to reflect changes to:

• The Services or available integrations;
• Applicable laws and regulations;
• Security requirements;
• Third-party platform requirements;
• Industry practices; or
• Our compliance and risk-management procedures.

The updated Policy will be posted with a revised “Last Updated” date. Where required by law or where a change materially affects your rights or obligations, we may provide additional notice.

Your continued use of the Services after an updated Policy becomes effective constitutes acceptance of the updated Policy, subject to applicable law.
